These Terms & Conditions govern your use of the Workout Express app and website (the "Service"). The Service is provided by Workout Express ("we", "us", "our"), the seller of the Service. By creating an account or continuing to use the Service, you agree to these terms. If you do not agree, please stop using the Service.
You are contracting with Workout Express. You confirm that you are of legal age to enter this agreement, or that you have authority to bind the organisation you represent, and that the information you provide is accurate and kept up to date.
Workout Express provides workout programming, exercise demonstrations, training logs, nutrition plans and progress analytics. Some features are available only to Premium subscribers. We may add, change or remove features over time.
Workout Express is a fitness and educational tool, not medical advice. Consult a qualified professional before starting any exercise or nutrition program. You train at your own risk.
You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately if you suspect unauthorised use.
You must not misuse the Service. In particular, you must not:
Workout Express retains all ownership of the Service and its intellectual property, including software, programming content, exercise media, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. You retain ownership of the content you enter (such as your logged sets and notes) and grant us a limited licence to host and process it solely to provide the Service.
We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability and fitness for a particular purpose.
All Access is a single one-time purchase at the price shown on our pricing page. There is no subscription and nothing renews — you pay once and retain access to the service for as long as it is offered. There is therefore nothing to cancel.
Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by our reseller. Please see the Paddle Buyer Terms and our Refund Policy.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, you may request an export of your training data within 30 days, after which it may be deleted.
To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence where such exclusion is not permitted by law.
You agree to indemnify Workout Express against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the jurisdiction in which Workout Express is established, and disputes will be handled by the courts of that jurisdiction. We may update these terms and will post the revised version here.
